On Monday, the family members of farmers who died during the Lakhimpur Kheri protest, are now challenging the bail granted to the main accused Ashish Mishra in the Supreme court. Mishra is the son of Union Minister, Ajay Mishra of Bhartiya Janata Party.
On February 10th Mishra was granted bail by the Allahabad High court, in a hit and run case during farmers protest in Lakhimpur Kheri, Uttar Pradesh. On October 3, Mishra ran over a bunch of protestors, killing four farmers and one journalist. Later Mishra was caught on October 9 and was put behind the bars.
However, now the victims family alleges that Allahabad high court has failed them. The court is deliberately not letting them present important facts and evidence related to the case. Hence with the help of Sr. Lawyer Prashant Bhushan, the family will now challenge the bail granted to Mishra by the High court, in the apex court.
The members of the families also said that the High Court granted the bail without considering the heinous nature of the crime. They fear that he may flee from justice, tamper with the witnesses and repeat the offence. (Reported by Scroll)
Earlier, last week two advocates, Shiv Kumar Tripathi and CS Panda had also moved the Supreme Court against the bail order to Mishra. They had said that the High Court’s verdict was “unsustainable” in law and the bail order had “manifest error.”
Single-judge Justice Rajeev Singh of the Allahabad High Court had granted bail to Mishra stating that “there might be a possibility that the driver of the vehicle that mowed down the protesting farmers sped up the vehicle to save himself.”
